These Terms & Conditions govern the use of the EPM Machinery Inc. website and the purchase of used tractors, agricultural equipment, construction equipment, machinery, and related equipment through EPM Machinery Inc. (“EPM Machinery,” “EPM,” “we,” “us,” or “our”).

By using this website, requesting information about equipment, placing an order, or purchasing equipment through EPM Machinery, you acknowledge that you have read and agree to these Terms & Conditions, together with any applicable invoice, purchase agreement, and other documentation provided for your transaction.

1. About EPM Machinery

EPM Machinery Inc. is a used equipment company serving customers throughout Canada and the United States.

We source used tractors, agricultural equipment, construction machinery, attachments, and other pre-owned equipment from private sellers and other equipment sources throughout North America.

Equipment available for purchase may be located at different locations and may not be physically located at an EPM Machinery office.

Our inventory changes frequently. If a particular machine is not currently listed on our website, customers may contact us with their requirements and EPM Machinery may attempt to locate suitable equipment through its network.

2. Equipment Listings

EPM Machinery makes reasonable efforts to provide accurate and detailed information about equipment listed on our website.

Listings may include information such as:

  • Make and model
  • Year
  • Hours or mileage
  • Specifications
  • Equipment condition
  • Photographs
  • Location
  • Attachments and accessories
  • Purchase price
  • Other relevant information available to us

We make every reasonable effort to disclose known material information about each machine in its listing.

Used equipment may show normal signs of previous use, including wear, cosmetic imperfections, repairs, modifications, and age-related conditions.

Photographs are provided to help buyers evaluate the equipment and may not show every aspect or minor imperfection.

Equipment specifications, availability, hours, location, and other listing information may change before a purchase is completed.

Customers should contact EPM Machinery before purchasing if they require clarification or additional information about a particular machine.

3. Equipment Availability

All equipment is subject to availability.

An equipment listing on the EPM Machinery website does not guarantee that the equipment will remain available until a purchase is completed.

Equipment may be sold, withdrawn, or become unavailable before payment is received.

EPM Machinery reserves the right to correct errors in listings, including errors relating to price, specifications, availability, photographs, or other information.

4. Purchasing Equipment

Customers interested in purchasing equipment should contact EPM Machinery directly.

The purchasing process generally involves:

  1. Selecting the equipment.
  2. Confirming availability with EPM Machinery.
  3. Reviewing the applicable equipment information and purchase documentation.
  4. Receiving an invoice or other purchase documentation.
  5. Completing payment according to the provided payment instructions.
  6. Receiving confirmation of payment and the purchase.
  7. Arranging delivery or pickup.
  8. Receiving the equipment.

A purchase is not considered complete until EPM Machinery has confirmed the transaction and all applicable conditions of the purchase have been satisfied.

The applicable invoice, purchase agreement, and other transaction-specific documents may contain additional terms that apply to a particular purchase.

5. Purchase Price & Taxes

Unless otherwise stated, the purchase price displayed or quoted by EPM Machinery includes applicable taxes.

The applicable price and tax information will be confirmed in the invoice or other purchase documentation provided to the buyer.

For purchases involving transportation across the Canada–United States border, additional customs duties, import charges, brokerage fees, or other governmental charges may apply depending on the transaction and destination.

6. Payment

Bank Transfer Only

All equipment purchases must be paid by bank transfer.

EPM Machinery accepts payment by bank transfer to the Canadian or United States bank account specified on the official EPM Machinery invoice or other official payment documentation.

No equipment will be released for delivery or pickup until payment has been received and confirmed by EPM Machinery.

Payment Verification

Customers should carefully verify all payment instructions before sending funds.

If a customer receives a request to change bank account information or payment instructions, the customer should independently confirm the change directly with EPM Machinery before sending payment.

Customers should only send payment to the bank account specified in official EPM Machinery payment documentation or otherwise confirmed directly by EPM Machinery.

Payment Confirmation

Payment must be received and cleared before EPM Machinery begins the delivery process.

A pending, incomplete, reversed, rejected, or otherwise unconfirmed payment does not constitute payment in full.

7. Delivery & Transportation

Delivery arrangements will begin only after payment has been received and confirmed by EPM Machinery.

EPM Machinery may assist in coordinating transportation through appropriate transportation providers.

Delivery times depend on factors including:

  • Equipment location
  • Delivery destination
  • Equipment size and type
  • Carrier availability
  • Weather and road conditions
  • Border or customs requirements, where applicable
  • Other circumstances outside EPM Machinery’s control

Estimated delivery dates and times are estimates only and are not guaranteed unless specifically agreed to in writing.

Any applicable transportation costs will be communicated to the buyer before the purchase is completed.

Customers are responsible for providing accurate delivery information, including the correct delivery address and any information reasonably required to coordinate transportation.

8. Pickup

Where pickup is available, the applicable pickup arrangements will be communicated to the buyer.

Equipment will not be released for pickup until payment has been received and confirmed and all applicable purchase requirements have been completed.

The buyer is responsible for ensuring that the pickup location is accessible and that any required loading, hauling, permits, insurance, or other arrangements are properly addressed unless otherwise agreed in writing.

9. Equipment Condition

All equipment is used or pre-owned unless expressly stated otherwise.

Used equipment may have mechanical, cosmetic, electrical, structural, or other conditions associated with its age, hours, previous use, maintenance history, or modifications.

EPM Machinery provides buyers with the equipment information available to us and makes reasonable efforts to accurately describe the equipment in each listing.

Buyers are encouraged to review the listing carefully and discuss any questions or concerns with EPM Machinery before completing a purchase.

Any specific warranty provided with an individual machine will be stated in the applicable purchase documentation.

10. Inspection Before Purchase

Customers may request additional information about equipment before purchasing.

Where practical and available, EPM Machinery may provide additional photographs, videos, specifications, documentation, or other information concerning the equipment.

Customers may also make their own inspection arrangements before completing a purchase, where applicable.

The buyer is responsible for reviewing the equipment information and asking any questions they consider necessary before completing the purchase.

11. Seven-Day Inspection & Refund Policy

EPM Machinery provides a 7-day inspection period following delivery of applicable equipment.

The purpose of the inspection period is to allow the buyer to confirm that the equipment materially corresponds with the description and information provided by EPM Machinery.

Refunds are accepted only when:

The equipment materially differs from the description provided by EPM Machinery.

A refund request must be submitted to EPM Machinery within the 7-day inspection period after delivery.

Normal wear and tear, ordinary cosmetic imperfections associated with used equipment, or conditions that were disclosed in the equipment listing do not, by themselves, constitute grounds for a refund.

EPM Machinery will review the buyer’s claim and determine whether the equipment materially differs from its description.

If EPM Machinery approves a return, the buyer will be provided with instructions regarding the return of the equipment.

12. Approved Returns & Refunds

When a return is approved because the equipment materially differs from its description, EPM Machinery will cover the reasonable cost of returning the equipment through the transportation arrangements approved by EPM Machinery.

The equipment must be returned in substantially the same condition in which it was delivered, except for the condition giving rise to the approved return.

Once the equipment has been returned and the applicable return requirements have been completed, EPM Machinery will process the approved refund.

Approved refunds will be processed within 30 days.

The refund will be made by bank transfer to an account designated by the buyer and confirmed by EPM Machinery, subject to applicable banking requirements.

13. No General Change-of-Mind Returns

EPM Machinery does not offer returns or refunds simply because a buyer changes their mind, no longer needs the equipment, finds another machine, or is dissatisfied with a purchase for reasons unrelated to a material difference between the equipment and its description.

The 7-day inspection and refund policy applies only to situations covered by the policy described in these Terms & Conditions and any rights that cannot legally be excluded or limited under applicable law.

14. Ownership & Documentation

Ownership and title documentation will be handled in accordance with the applicable purchase documentation and applicable law.

Where applicable, EPM Machinery will provide available ownership, registration, or other relevant documentation associated with the equipment.

The buyer is responsible for ensuring that any registration, licensing, import, tax, insurance, or other requirements applicable to the buyer’s use of the equipment are satisfied.

15. Taxes, Registration & Import Requirements

Applicable taxes are included in the purchase price unless otherwise stated.

For cross-border purchases between Canada and the United States, additional customs, import, export, brokerage, registration, or governmental requirements may apply.

The buyer is responsible for complying with requirements applicable to the destination and intended use of the equipment, except for obligations expressly undertaken by EPM Machinery in writing.

16. Equipment Use

The buyer is responsible for ensuring that the equipment is suitable for the buyer’s intended application, location, operating conditions, and legal requirements.

The buyer is responsible for complying with applicable safety requirements, operating instructions, licensing requirements, and laws governing the use of the equipment.

17. Website Information

EPM Machinery makes reasonable efforts to keep website information accurate and current.

However, information on the website may contain errors, omissions, or information that has changed since publication.

EPM Machinery reserves the right to update, correct, modify, or remove website content at any time without prior notice.

Website information does not replace the specific terms contained in the applicable invoice, purchase agreement, or other transaction documentation.

18. Website Use

Users agree not to misuse the EPM Machinery website, attempt to gain unauthorized access to website systems, interfere with website operation, or use website content for unlawful purposes.

EPM Machinery reserves the right to restrict or terminate access to the website where reasonably necessary to protect the website, its users, or the company.

19. Limitation of Liability

To the extent permitted by applicable law, EPM Machinery’s liability arising from a transaction will be governed by the applicable purchase agreement and applicable law.

Nothing in these Terms & Conditions is intended to exclude or limit any right, warranty, condition, or liability that cannot legally be excluded or limited under applicable law.

20. Force Majeure

EPM Machinery is not responsible for delays or failures caused by circumstances beyond its reasonable control, including severe weather, transportation delays, accidents, natural disasters, government actions, border delays, strikes, carrier delays, communication failures, or other circumstances beyond EPM Machinery’s reasonable control.

21. Changes to These Terms

EPM Machinery may update these Terms & Conditions from time to time.

The version posted on the website will apply to future website use and transactions, subject to any applicable transaction-specific agreement and applicable law.

22. Governing Law

The applicable law governing a particular transaction will depend on the circumstances of the transaction, the applicable purchase documentation, and applicable law.

Nothing in these Terms & Conditions is intended to deprive a consumer of mandatory rights or protections provided by applicable law.
